I will have to disagree about the ghost part because in tha case why 
is that Harry's parents haven't show up in all these years if both 
have murdered? 

About the Fawkes theory, in case you are right and that is why they 
are called the Order of the Phoenix, it could led to think that this 
group is the one who is going to fight with most of Voldemort allies, 
since they can reborn as much as they want. Now, it is also truth 
that Fawkes was never killed, the only time we have read of his 
reborn was when Fawkes died of natural reasons, so who knows if 
Phoenix can reborn if they are killed?
