My understanding was that only they could RETRIEVE from the Dept of 
Ministries, but there was nothing to stop them giving it to someone 
else - which is why Voldemort enticed Harry in there, so he could 
retrieve the prophecy then pass it on to the Death Eaters. HArry has 
already retrieved it; he can give it to Neville or a Death Eater or 
anyone.
