The problem with that (imo), is that it doesn't matter whether the curse
worked 'properly' or not, the danger is that Harry intended to use the
Cruciatus Curse. He knew what it did (not only from first hand experience,
but also he saw what it did to Neville's parents only just recently), and he
did it anyway. It's comparable to giving someone a gun and giving the
person blanks instead of live rounds. To the person, he/she truly believes
that when they use the gun, it will kill someone.
Bad analogy, but only one I could think of.....
Anyway, my 1/4 galleon...
