Since we know nothing about this, JKR can arrange it to suit her plot
convenience. I shudder to think of Draco or Narcissa inheriting it...
Now me -
Assuming we're keeping within shouting distance of muggle inheritance law
(and I admit my knowledge of this is more based on the medieval system than
the modern, but I figure the wizarding world probably is too) then it wouldn
t go to Harry if Sirius died without a will. If however he left a will then
there's no way it would go to the Lestranges or the Malfoys. The will would
probably be before he got arrested so since he hated his family he would
(presumably) either have left his stuff to a Marauder (please God not Peter)
or all the Marauders for all we know, or the Weasley branch of the family
since even if he didn't know them too well they'd be better than the
alternatives. Young people don't tend to write wills and he was early
twenties when arrested (and presumably didn't own the house then either)
*but* Sirius is a special case since he hated his family. He may have left a
will just to piss them off and guarantee they couldn't get their hands on
his stuff. Plus if I were him I'd have made a will before becoming Secret
Keeper - just in case. Let's hope that means either remus or the Weasleys
benefit. Personally my money's on the Weasleys because he didn't trust Remus
at the time.
