I've weighed in on this subject in the past, and will add my
impressions again.

Originally, Hagrid is expelled and has his wand broken. I sense that
this was done by an official ruling from the Ministry of Magic rather
than a sanction that is limted to the school. We do see in the current
book (OotP), that Hagrid is worried about being seen doing magic by
Ministry Aurors who follow him will he travels in Europe over the
summer. He has never expressed any concern about someone at school
catching him doing magic. In fact, everyone at the school has always
conviniently looked the other way while Hagrid performs magic at the
school (Example; enlarging/engorging the Holloween pumpkins to the
size of garden sheds).

Conclusion, his explusion wasn't limited to his removal from the
school by the school authority. If it were, then Dumbledore could
restore Hagrid's status at any time. 

This leads me to conclude, as I said before, that it is the Ministry's
authority that prevents Hagrid from practicing magic. Since he is
convicted and banned by an official ruling of the Ministry of Magic,
the Ministry will have to hold a hearing and reverse their original
ruling. 

In the meantime (between CoS and now) Hagrid is given even more leeway
in preforming magic as well as being made a professor. Unoffically,
everyone knows Hagrid is innocent and doesn't care if he performs
magic, but the official ruling still stands.

To the issue of Hagrid needing to go back to school to become an
offical 'qualified' wizard; I don't think so. Hagrid is an adult (over
17) and he has 50 years of experience, not to mention having spent
those 50 years living at the best wizard's school in Europe. O.W.Ls
and N.E.W.Ts are like any school qualification, they give potential
employeers an indication of your capabilities and helps them determine
if you would be able to do a potential job that they might hire you
for. I personally don't see them as an absolute requirement any more
that a high school diploma is an absolute requirement in the real world.

Conclusion, Hagrid will not be required to go back to school; third
year training plus 50 year experience will be enough.

All that has to happen for Hagrid to walk into Ollivander's and buy a
new wand, is an offical reversal of his original conviction by the
Ministry. Given that Fudge's credibility is shot, I think he will be
very will to be accomadating in order to show himself in the best light. 

Personally, I REALLY REALLY hope Dumbledore forces the Ministry to
reverse Hagrid's conviction because I really want to see him get that
new wand. Plus, the wizard world is in a critical state right now and
they need all the help they can get. It would be foolish on their part
to not use Hagrid to his full potential.
