No, sucking Harry's soul out would on the contrary make him quite 
believable to the world.
I think that Umbridge instructed the dementors to kiss someone else in 
front of Harry, so he'd have to use magic, and thus, be expelled from 
Hogwarts.

Since Dudley was with him at that moment, he got targetted, it might as 
well have been the milkman or Elton John, if he'd been there.
