1)  I don't think MoM is monitored.  Also, I don't think Hogwarts' 
students are monitored during the school season... only during summer 
holidays.
2)  Harry's 'attempted' use of the unforgivable curse does not make 
it ok.   Sure, it may not deserve a life sentence in Azkaban, but the 
attempted pain/assault may get some time there.
3)  I haven't heard your theory of the criteria for being an 
Unforgivalbe Curse.  I like it.  It's giving me something to chew 
on.  Thanks.
