Actually, at the time those events took place, Sirius had not 
confronted Peter yet so there was no reason that he couldn't have 
taken Harry with him other than Dumbledore had ordered Hagrid to 
bring him to Privet Drive.   So, at least at that point it had 
already been decided (by Dumbledore) that Harry would have to live 
with his relatives...
