I still think it's a wand and I'll elaborate in a moment. First I want to say that I agree with posters who'd said the Muggleborns kids are probably monitored more than Wizardborns - they know less about the stuff, so they can be more dangerous, especially when they start to show off in front of their old Muggle pals during holidays. And there is less help promptly available in case anyhing goes really wrong.
I think children below Hogwarts age are regarded as sole responsibility of parents and also not very powerful, since they are wandless ("you'll never have as good results using sb.'s else wand" - Ollivander). And also that magic filed areas like Diagon Alley are not really monitored, so Hermione reparing Harry's glasses goes unpunished.
The location/Muggle present theory brings a problem of Muggle detection - how do they do tis? It's harder to keep track of somebody without magical ability than on wand I presume, and besides there is 60 milions of them in UK, the vermin is swarming everywhere.
The wand tracing theory explains Order members using their magic in Privet Drive. As for Dobby - I think it can be a hole in detection system. SInce his magic is not attributable to any wand, it was "automatically" attributed to the closest wand. At the same token his magic performed in the Malfoy Mansion will b attributed to one of the owners - which accidentaly makes sense, because it gives additional responsibility to the masters for their elf misbehaviour.
