Toffe incident supports the "wand tracing theory". Besides there was a Ministry Official there and from the ofice quite suited to deal with such cases. The incident was also not big enough to attract much attention (like regurgitating toilets fo example).
And last, but not least - as it was said before - law can be stretched a bit, this or that way.
