Actually, before anyone can claim the property, they'd have to prove
that Sirius was dead.  No body, no evidence of death.  

One of the things I'm interested in seeing in HBP is how Dumbledore
handles this issue: does keeping the myth of
fugitive-Sirius-on-the-run allow them to continue using 12GP as an
HQ?  Or would there be some reason why Sirius' death should be
acknowledged publicly?
