I wondered that myself after the first reading or two. However, upon 
reflection, there are numerous cases of people mentioning the 
multitude of different protection Dumbledore has placed on Harry at 
Hogwarts. It's my belief that it is impossible for Harry to be taken 
whiel Harry is there, unless it is some form of transportation that 
has been cleared. Thus normally any kind of portkey would not work, 
yet since this was a portkey Dumbledore knew of it was cleared for 
harry to use.
