Some major hurdles for Fawkes being DD's Horcrux:
1. DD would've had to commit murder to create the Horcrux: "By an act

2. DD's portrait: "And a new portrait had joined the ranks of the dead
headmasters and headmistresses of Hogwarts ... Dumbledore was

Ch. 29, The Phoenix Lament)
2. DD did not fear death: "After all, to the well-organised mind,
death is but the next great adventure." (PS Ch. 17, The Man with Two
Faces)
LUCKDRAGON:
1) We don't know everything DD has done in the past. During LV's last war he could have found himself forced to kill and had the foresight to create a horcrux as a result.
2) DD is a great wizard. The portrait could be magical.
3)He may not fear death, but that doesn't mean he is ready for it now. Flamel lived to 600, DD still has a few good years left.
