Some major hurdles for Fawkes being DD's Horcrux:
1. DD would've had to commit murder to create the Horcrux: "By an act
of evil - the supreme act of evil. By committing murder." (HBP Ch.
23, Horcrux)
2. DD's portrait: "And a new portrait had joined the ranks of the dead
headmasters and headmistresses of Hogwarts ... Dumbledore was
slumbering in a golden frame over the desk, his half-moon spectacles
perched upon his crooked nose, looking peaceful and untroubled." (HBP
Ch. 29, The Phoenix Lament)
2. DD did not fear death: "After all, to the well-organised mind,
death is but the next great adventure." (PS Ch. 17, The Man with Two
Faces)
