What
could be the loophole, the flaw in this scene?  There must be one
somewhere.

Part of me wondered if Dumbledore actually thought Snape and the others were going to come to the tower that night.  He even told that to Malfoy...and he knew that Draco wasn't going to kill him.  
 
So the loophole could be "Yes" you got me here but "No" there won't be a killing.
