Actually he was slipping on the floor when he finally used 
Sectusemptra, so I see it as a last desperate attempt to defend 
himself. So I am really not sure how many alternatives he had at 
that point. Step behind a physical barrier? Malfoy could have hit 
him while he was trying to get up first.

Sectusemptra is not the best choice, sure, but I see nothing strange 
that when he is down, he would use the curse that he remembers 
marked for enemies.

Oh, and I would think that spitball is not quite in the same league 
as Unforgivable.

IMO of course.
