It's possible that snape had taught it to some other students and james had
just picked it up from the. Looking at the social dynamic there it's not
likely that the marauders would have believed Snape if he told them he
invented it. Lupin does say something like "at times you couldn't move for
being hoisted up by your ankle" (I don't have a book handy for the exact
quote). So if the spell had become popular there is no reason to suggest
James "stole" it from Snape rather than just picking it up around the
school.  Snape of course would see it very differently.
