Because the death didn't actually occur. What actually happened is that
two Harrys and Hermiones were both there, and the axe swipe they heard
was not ever Buckbeak being killed, it was the executioner smacking it
in frustration at the fact Buckbeak was gone. Saving Buckbeak didn't
happen later, it happened right when we were reading it the first time,
except we didn't know it then. :)
Plus, as you said, I doubt JKR would be so unoriginal as to repeat the
exact same kind of thing twice like that. The only thing I expect out
of GoF is to be surprised. :) We may indeed see a ghost of whoever dies
later, but the person is still dead. Obi-Wan and Yoda were still toast
at the end of Jedi.. It's just showing the truth of the matter, that we
are beautiful beings with indestructable souls that will live on after
we leave this world.
