OK, here are my two cents: The diary is certainly part of lots and lots of Dark Arts items Lucius keeps at his manor. He's trying to sell some of the hotter stuff to Mr. Borgin at the beginning of CoS, as we all know and Draco boasts about it to polyjuiced Ron&Harry.

My theory would be that, with the new Muggle Protection Act coming up (and I'm sure it means that Muggles are to be protected, not wizards *from* Muggles), the MoM keeps a closer watch on those who are harbouring evil intentions against Muggles- which means Voldemort's supporters including above all the DEs. So, Lucius considers that time is ripe to get rid of some of his devotionalia and goes through all those Dark Objects he has accumulated during the years. As he was a prominent and trustworthy DE, Voldemort had left most of his belongings at Malfoy Manor. (It seems that Voldemort didn't have a house where he used to live, maybe he did like Charlemagne and stayed with each DE for a certain time.) Among those belongings, there was his enchanted diary.

So, when Lucius decides what to sell and what to keep, he hits upon the already forgotten diary. Either he has known all the time how it works or he finds out now. And a brilliant plan begins to form: What if he manages to give the diary to a Muggle- born or halfblood Hogwarts student, preferably a girl because more inclined to keep a diary? If things really work out the way they should, all attempts at a Muggle Protection Act would be in vain. So he goes to Diagon Alley, searching for a victim. And destiny offers him THE chance, better than anything he had excogitated: He slips the diary to Ginny Weasley, the daughter of the man who is working so hard for Muggle protection.

I hope this wasn't too fanfic-ish.
